Several recent decisions of the Employment Court have highlighted a potential increase in the legal exposure for employers when restructuring or making staff redundant. There is increasing scope for the Court to examine an employer’s business decision in redundancy situations, as well as the selection criteria and redeployment processes that the employer has used.
